1. Agreement to Terms

By accessing or using DomainInit ("the Service"), operated by Typend ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

DomainInit is a curated marketplace for premium domain names. We facilitate the listing, discovery, and inquiries related to domain names. We are not a domain registrar and do not handle domain transfers directly.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Attempt to interfere with, compromise the system integrity or security of the Service
• Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature
• Use any robot, spider, or other automatic device to access the Service

4. Domain Listings and Transactions

All domain listings on DomainInit are subject to availability. Prices listed are subject to change without notice. We reserve the right to refuse service, terminate accounts, remove or edit content at our sole discretion.

Inquiries submitted through the Service do not constitute a binding offer or acceptance. All transactions are subject to final agreement between the buyer and seller.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Typend and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Typend.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TYPEND EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that the Service will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or that any errors will be corrected.

7. Limitation of Liability

IN NO EVENT SHALL TYPEND, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

8. Indemnification

You agree to defend, indemnify, and hold harmless Typend and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and the parties hereby consent to personal jurisdiction and venue therein.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

These Terms constitute the entire agreement between you and Typend regarding the use of the Service and supersede all prior and contemporaneous written or oral agreements.
